Hotels and other suppliers providing travel or other services for Zapotel, Inc. are independent contractors and not agents or employees of Zapotel, Inc. or its affiliates. Zapotel, Inc. and its affiliates are not liable for the acts or negligence of those hotels and suppliers. We recommend travel insurance to cover such occurrences.
Zapotel Inc. (also known as the Zapotec Tours/Zapotel, Inc. and herein referred to as Agent) will make arrangements with hotels, travel agencies, tour operators and other independent suppliers to provide you with services in Mexico. We take all reasonable steps to ensure that proper arrangements have been made. However, the Agent does not accept liability for the actions or omissions of these independent suppliers, over whom we have no direct control. We are sure you understand that we cannot control such factors as government actions, weather, mechanical breakdowns, pilferage, labor disputes, quarantining, medical problems, your physical or medical disabilities, failure to obtain valid travel documents or failure to follow travel instructions or purchase travel insurance. The Agent is not responsible for losses or damages arising from physical or emotional injury or the economic damage caused by such factors beyond our control.
Zapotec Tours/Zapotel Inc. acts solely as agent in making such arrangements and does not assume any liability whatsoever for any injury, loss, damage, death, accident or delay to person or property due to an act of negligence or default of any hotel, air carrier, ground transportation, restaurant, company or person rendering any of the services arranged for nor by any 'act of God'. No responsibility is accepted for any additional expense, omissions, delays or rerouting due to acts of any government or authority.
No contract of any kind has been created nor exists between Zapotel, Inc. and a client submitting a Reservation Request until the availability of funds has been verified and until the client's credit card has been charged by Zapotel, Inc. for the amount specified and approved by the credit card company. Nor does any contract pre-exist between the hotel and the client submitting a Reservation Request until the availability of the room type and dates requested has been verified with the hotel's onsite reservation manager.
Use of a Zapotel website for hotel reservations indicates agreement with these Terms and Conditions. Use of our websites indicates that you understand the polocies of Zapotel, Inc.
